Virginia Constitutional Amendment for Unlimited Abortion
Virginia is already the most pro-abortion state in the South with virtually zero protection for preborn babies. On top of that, an Abortion Amendment is in process that would enshrine “reproductive rights” into the state constitution.
This is a major threat to Pregnancy Centers. If the amendment passes, it could easily be interpreted to mean that PRCs that don’t offer abortion services are “denying, burdening, or infringing” on the rights of Virginia citizens. We would be exposed to legal threats that could hamper or even stop our ability to minister to women and babies in our communities.
When the General Assembly (GA) began its 2026 session on January 14th. The proposed “abortion amendment” passed the House on January 14th and the Senate on January 16th. This will go to the Virginian’s voter ballet for a popular in November of 2026.
The Family Foundation writes this:
“If passed, the no-guardrails abortion amendment would legalize abortion up to birth, erase parental consent, and stop reasonable safety standards.”
Some frequently asked questions about the Abortion Amendment:
What is HJ1, “Reproductive Freedom Amendment?”
- It is an amendment that will enshrine, or permanently embed, abortion in our state’s constitution. This makes it extremely difficult for future legislatures to amend or repeal.
Can the governor veto the amendment?
- No. A proposed constitutional amendment must pass two consecutive legislative sessions with an election between the sessions. It will then go to the ballot for Virginia citizens to vote and will pass/fail by a simple majority.
I have read the amendment, and I don’t see where it says, “Unlimited Abortion.”
- It is not necessarily what the amendment says, but what it doesn’t say that’s important. There is no provision for parental consent for minors. There is no provision for the baby’s gestational age. In simple terms, this means minors can have an abortion without their parents’ consent, and abortions can be obtained through birth.
Don’t we have laws in place for parental consent and gestational age?
- Yes, but a constitutional amendment will trump all those laws and make it impossible for future prolife legislation to be passed.
How will the amendment be presented on the ballot?
- The question on the ballot is a bit deceptive in its wording and might be difficult for the average voter to understand without looking into its true meaning.
- The question reads, “Question: Should the Constitution of Virginia be amended to (i) protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient’s health is at risk or the pregnancy cannot survive?”
Well, I believe women should have access to miscarriage management.
- We agree, but miscarriage management is not an abortion.
Can you tell us some good news?
- The good news is that these young women, and men, will continue to have access to the services of BRWC and will still hear the gospel… every single day. Hope will overcome fear. Precious lives will be saved. Young families will be supported. Generations will be impacted in the name of Jesus. And all of this possible because our brothers and sisters in Christ offer their time, treasure and talent to stand with us for LIFE.
